Every guarantee I make, with the conditions attached.

The full written terms of every guarantee I offer buyers and sellers in Davis and Salt Lake County, conditions included, so you can read them before you sign anything.

Why this page exists

A guarantee without its conditions is marketing. A guarantee with its conditions is a promise.

Everywhere else on this site I state these in one line, because one line is all a page about buying a home has room for. This is where the whole thing lives. Every term below is taken off the signed certificate you are handed before you sign anything, and if the certificate you receive ever differs from what you read here, the certificate is the one that counts.

Read them before you need them. That is the only time reading them is easy.

Savings Guarantee: I negotiate a set amount off, or I pay you

When you find the home you want, I negotiate for you to buy it for at least the amount below off the asking price. If I cannot, I pay you the difference out of the compensation I receive at closing.

At $1,000,000 and above: at least $20,000 off, or I pay you up to $5,000.

From $500,000 to $999,999: at least $10,000 off, or I pay you up to $2,500.

Below $500,000: at least $5,000 off, or I pay you up to $1,000.

What counts as savings. The price reduction off the list price, plus seller-paid closing costs, repairs, improvements and any other seller-paid concessions, added together.

Conditions. You provide a written pre-approval letter from a major lender, dated within 30 days of your initial offer, or written verification of cash funds in your name submitted with the initial offer. The property is listed at $400,000 or more. The property is not one listed by Home Click Real Estate. Your initial offer must be at least the guaranteed amount below the asking price for your tier, and if it is not, this guarantee does not apply.

How the credit works. If at closing the combined total of price reduction, seller-paid closing costs, concessions and repairs is less than the guaranteed amount for your tier, I credit you the difference at closing, up to the amount shown above. It is paid from the compensation I receive at closing, which is 3% of the net sales price as agreed in your Buyer Agency Agreement.

Definitions. List price means the Multiple Listing Service (MLS) list price on the date your initial offer is submitted. Your tier is set by the final purchase price shown on the settlement statement.

Buyer Satisfaction Guarantee: I buy it back or sell it for free

If within 24 months of the date you close you decide to sell the home you bought through me because you are not satisfied with it, I will buy it back or sell it for free.

Which of the two is my decision, not yours. I would rather you know that now than in month 20.

Conditions. You buy another home of equal or greater value through me as your exclusive buyer broker, within a one hour drive of the Home Click Real Estate corporate office. You sign a Buyer Agency Agreement for that purchase at a compensation of 3% of the purchase price, plus a $695 transaction fee. If the seller is not paying that amount, the difference is yours, which is what your Buyer Agency Agreement already provides.

Sell it for free means I take no listing-side compensation on the sale of your home. You remain responsible for the buyer-side compensation, 3% of the sales price plus a $695 transaction fee, whether or not I am also the agent who brings the buyer.

If I buy it back, the purchase price is the lesser of two figures: 95% of the original net sales price you paid, after concessions, or the current Federal Housing Administration (FHA) appraisal price minus 7%, which is 6% compensation plus 1% closing costs. You complete the repairs required to meet that loan's standards before closing. These terms, and the other standard terms, go on a Utah Real Estate Purchase Contract signed by all parties.

Cancellation Guarantee: you are never stuck with me

Signing a buyer agreement with an agent is a commitment. It should not be a trap.

Most buyer agreements lock you in with long protection periods and a fee to get out. Mine does not. You may cancel our buyer agreement at any time before an offer of yours is accepted. No penalty, no fee, no obligation. If my service is not what I told you it would be, you should not have to pay to leave.

If you would rather I fixed it. Tell me in writing what is wrong and I have 24 hours to put it right. If I cannot fix it to your satisfaction, I release you from the agreement unconditionally.

This certificate does not replace your Utah Buyer Agency Agreement. It is my personal promise in addition to it.

Home warranty: covered, up to $700 from me

I negotiate a one-year home warranty for you at no cost to you. If I cannot get the seller to pay for it, I pay up to $700 toward it myself.

$700 is a ceiling rather than a flat contribution. If the policy costs less, the lower figure is what I pay. If it costs more and the seller will not cover the balance, the balance is yours and you will know that before you commit to anything.

What I am paid, and who pays it

My compensation for a purchase is 3% of the purchase price, plus a $695 transaction fee payable at closing to Home Click Real Estate for processing the transaction.

Compensation is negotiated between us and is set by our agreement. It is not set by law, by any rule, or by any rate or practice.

I ask the seller to pay it on your behalf, and I tell you in writing what the seller has agreed to before you make your offer. If the seller pays less than the amount above, the difference is yours. I will not accept more than that amount from any source, and if what the seller offers is greater, the excess is credited to you at closing.

On most purchases this is why representation costs a buyer nothing out of pocket. On some it does not, and you will know which one you are in before you write an offer rather than after.

On the selling side

Sellers get written commitments too, and they are a separate set of documents.

The Listing Cancellation Agreement. A standard listing agreement with a written cancellation you can use any day before an offer is accepted. No fee, no penalty. The same thinking as the buyer cancellation guarantee: if the marketing is not what I said it would be, you should not be locked into it.

The Guaranteed Sale Program. We agree on a price and a timeline in writing. If your home does not sell on those terms, I either buy it myself or sell it without charging you a listing commission, and which of the two is my choice. Without a listing commission means you pay no listing-side compensation; the buyer's agent compensation, 3% of the sales price, and a $695 marketing fee still apply, whoever brings the buyer. Not every home qualifies, and the price and timeline are set when I see the property rather than published as a single number that would be wrong for most houses.

Both are written out in full before you sign anything. Ask me for them and I will send them to read, with no obligation and no appointment required.

This page describes the guarantees I offer and is not legal, tax or lending advice. The signed certificate for any guarantee is the binding document.

Frequently Asked Questions

Does the savings guarantee apply to every home?

No. The property has to be listed at $400,000 or more and cannot be one of my own listings, you need a written pre-approval dated within 30 days of your initial offer or verification of cash funds, and your initial offer has to be at least the guaranteed amount below asking. If it is not, the guarantee does not apply.

If I am unhappy with the home, do I choose whether you buy it back or sell it?

No, that choice is mine rather than yours. You buy another home of equal or greater value through me, within a one hour drive of my office, at 3% plus a $695 transaction fee. If I buy it back, the price is the lesser of 95% of the original net sales price after concessions, or a current Federal Housing Administration (FHA) appraisal minus 7%.

What does it cost me to cancel?

Nothing. You can cancel the buyer agreement at any time before an offer of yours is accepted, with no penalty and no fee. If you would rather I fixed the problem, tell me in writing and I have 24 hours to put it right, and if I cannot, I release you unconditionally.

Who pays you?

I ask the seller to pay my compensation on your behalf, and I tell you in writing what the seller has agreed to before you make your offer. If the seller pays less, the difference is yours. I will not accept more than 3% plus the $695 transaction fee from any source, and any excess is credited to you at closing.

Is your fee the standard rate?

There is no standard rate. Compensation is negotiated between us and set by our agreement. It is not set by law, by any rule, or by any rate or practice.

Do I get a home warranty?

I negotiate a one-year home warranty for you at no cost to you. If I cannot get the seller to pay for it, I pay up to $700 toward it myself. That is a ceiling rather than a flat contribution.
